Terms and Conditions
These Terms and Conditions (“Terms”) govern your use of the website operated by Timeless Legacy Collections Pvt Ltd (“Company,” “we,” “us,” or “our”) for the sale and auction of collectible items including but not limited to banknotes, coins, and stamps (“Products”).
By accessing or using our website, purchasing a product, or participating in an auction, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our platform.
1. Eligibility
- You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872.
- By using our platform, you represent that you are legally eligible to transact with us.
- Registration is mandatory to participate in auctions. Only registered Users shall be permitted to bid or purchase from auction or direct-sale listings.
- Each auction may require separate registration or confirmation of credentials before bidding is permitted. You must provide accurate information during registration, including name, address, phone number, and valid ID.
- We may verify your identity and we reserve the right to refuse registration, right to approve, reject, suspend, terminate or bidding privileges without assigning reason.
2. Product Information
- We sell collectible items including historical currency, rare stamps, and coins.
- All product listings include a description, image, and condition report (where applicable). While we strive for accuracy, minor discrepancies may occur.
- Products are sold on an “as-is” basis. We do not guarantee grading or certification unless explicitly stated.
3. Prohibited Items and Legal Compliance
It is strictly prohibited to consign, list, or transact:
- Counterfeit or forged coins, banknotes, or stamps
- Items classified as “prohibited” or requiring special permission under the Antiquities and Art Treasures Act, 1972
- Stolen, illegally obtained, or unprovenanced items
Any breach may result in account termination and legal action.
4. Ordering and Acceptance
- Orders can be placed directly on our website once it is live. Orders are confirmed only after payment is successfully received.
- We reserve the right to cancel any order due to pricing errors, stock issues, or suspicion of fraudulent activity.
5. Auction Participation and Bidding Rules
- Bidders must create an account to participate in auctions.
- All bids are binding and cannot be withdrawn once placed.
- In auctions, the highest bidder (subject to reserve) shall be the purchaser. We may define bid increment slabs, absentee bids, live online bidding etc
- The highest bidder at the close of the auction will be deemed the winner/ purchaser, subject to meeting payment obligations.
- The purchaser agrees to pay the bid price plus Buyer’s Premium, applicable taxes (GST, Service Tax, etc.), shipping/handling where applicable.
- Auction payments must be made within the timeline specified in the invoice, and settlements are processed within 12–15 working days of the auction’s close.
- Any part of the purchase price left outstanding after the action, shall be paid in full within seven (7) days of the date of auction. Without prejudice to any rights, the auctioneer reserves the right to charge interest on any overdue payment at the rate of 2½ % per month.
- We reserve the right to reject any bid or disqualify users for misconduct or bid manipulation.
6. Buyer’s Premium / Fees / Taxes
- Buyer agrees to pay a Buyer’s Premium as specified in each auction or sale catalogue (for example 10% of hammer price).
- All applicable duties, taxes (GST, etc.) shall be borne by Buyer.
7. Pricing and Taxes
- Prices are listed in Indian Rupees (INR) and are inclusive/exclusive of GST, as applicable.
- Tax invoices are issued in compliance with Indian GST regulations.
- Any customs duties (for international customers, if applicable) must be borne by the buyer.
8. Payment Terms
- We accept payments via secure third-party RBI-compliant payment gateways (e.g., Razorpay, Paytm, UPI, Net Banking, Debit/Credit Cards).
- Payment must be made within 7 days of invoice/date of auction (for successful bidders). Failure of payment will result in automatic cancellation of the order or bid.
- Consignments (if you are a seller) payment to you will be made after 45 days of auction conclusion and after clearance of funds, subject to unsold lots etc.
9. Condition of Items
- Items are sold as described in the catalogue/website listing. We endeavour to describe condition accurately, but you accept items may have age-related wear, defects. No warranty of merchantability or fitness.
- You accept that you have the opportunity to inspect the items or rely on photographs/descriptions. You agree to make your own judgement about condition, authenticity, etc.
- Items more than 100 years old may be subject to export restrictions / permissions under Indian law (e.g., antiques export)
10. Shipping, Insurance & Handling
- Products are shipped to the address provided during checkout.
- For dispatched items, shipping costs will be borne by Buyer (unless otherwise specified). Insurance for transit is recommended; Buyer may choose and pay for same
- We engage reputed logistics and courier partners for safe and trackable delivery.
- Delivery timelines vary by location but typically range from 3 to 10 working days post-payment.
- We are not liable for delays caused by courier partners, natural calamities, or regulatory checks.
11. Title, Risk & Export/Import
- Title to the item passes to Buyer once full payment is received and cleared. Risk of loss/damage passes to Buyer once item is dispatched (or delivered/collected).
- Buyer is responsible for any export/import restrictions, duties, permissions especially for items crossing international borders.
- We disclaim liability for any export prohibition, delay, confiscation of items by authorities.
12. Cancellation, Refunds, Unsold Lots
- Once a bid is accepted, the contract is binding; cancellations require our approval and may incur penalty.
- Given the nature of collectibles, returns are not accepted unless the item delivered is materially different from the description or defective.
- If we offer returns (rare for collectibles), conditions will be specified separately. In general, collectibles sold “as is” may not be returnable unless defective or mis-described.
- Unsold lots (in consignment sales) may be returned or re-offered in a future auctions.
- Refunds, if applicable, will be processed only after internal verification.
- Auction items are non-returnable and non-refundable.
13. Intellectual Property
- All content on the platform including text, images, logos, and product data is the property of Timeless Legacy Collections Pvt Ltd and protected under Indian IP laws. You shall not reproduce or use them for commercial purposes without our prior written consent.
- Unauthorized copying, reproduction, or scraping of content is prohibited.
- You agree not to misuse the website (no automated bidding bots, scraping, circumvention of bidding rules) and any breach may lead to suspension or termination of your registration and forfeiture of your bids/purchases.
14. User Conduct
You agree not to:
- Violate any applicable laws or regulations;
- Use false identity or misrepresent your affiliation;
- Engage in bidding manipulation or fraudulent activity;
- Interfere with or disrupt the website or its systems.
15. Limitation of Liability
- Our liability is limited to the amount paid by the user for the product or auction win.
- We are not liable for indirect, incidental, or consequential damages resulting from the use of the platform or products purchased.
- Nothing in these terms shall exclude our liability for gross negligence, fraud or death/personal injury caused by our negligence.
16. Force Majeure
We shall not be held liable for delays or failure in performance caused by events beyond our control, including but not limited to natural disasters, pandemics, cyber-attacks, war, or governmental actions.
17. Governing Law and Jurisdiction
- These T&C shall be governed by and construed under Indian law.
- Any disputes arising from the use of the platform or transactions will be subject to the exclusive jurisdiction of courts located in Bengaluru.
18. Miscellaneous
- These T&C, together with any Conditions of Sale, catalogue notices, constitute the entire agreement between you and us for the transaction.
- If any provision of these T&C is held invalid, void or unenforceable, such provision shall be severed and the remainder shall continue in full force and effect.
- No waiver by us of any breach by you shall constitute a waiver of any subsequent breach.
- You may not assign your rights or obligations under these T&C without our prior written consent. We may assign our rights or delegate our obligations.
19. Amendments
We reserve the right to modify these Terms at any time. Continued use of the platform post such updates implies your acceptance of the revised Terms.
20. Grievance Redressal
In accordance with Rule 4(5) of the Consumer Protection (E-Commerce) Rules, 2020:
